AGREEMENT TO TERMS

These Terms of Use (“Terms”) govern your use of the websites and mobile applications provided by Nstory Pte. Ltd. (or referred to as ("we", "our", “us” or "Nstory", “NEON”) (collectively the “Platforms”). Please read these Terms carefully. By accessing and using the Platforms, you agree that you have read, understood and accepted the Terms including any additional terms and conditions and any policies referenced herein, available on the Platforms. If you do not agree or fall within the Terms, please do not use the Platforms. By setting up your account, you confirm that you accept these Terms.
Supplemental terms and conditions or documents that may be posted on the site from time to time are hereby expressly incorporated herein by reference. We reserve the right, in our sole discretion, to make changes or modifications to these Terms of Use at any time and for any reason.

NEON is operated by Nstory Pte. Ltd., a company incorporated and registered in Singapore, whose registered office is at #13-04 Eon Shenton, 70 Shenton Way, Singapore 079118. Our Company registration number is 201220029K.

PURPOSE

NEON IS A TECHNOLOGY COMPANY WHICH PROVIDES A PLATFORM FOR CONSUMERS TO OBTAIN OR PROCURE GOODS AND SERVICES PROVIDED BY PARTNER OR US. WHERE THE GOODS/SERVICES ARE PROVIDED BY PARTNER, NEON’S ROLE IS MERELY TO LINK THE USER WITH SUCH PARTNERS. NEON IS NOT RESPONSIBLE FOR THE ACTS AND/OR OMISSIONS OF ANY PARTNERS. PARTNERS SHALL BEAR ALL LIABILITY IN RELATION TO SUCH GOODS AND SERVICES. PARTNERS ARE NOT, AND SHALL NOT HOLD THEMSELVES TO BE, AN AGENT, EMPLOYEE OR STAFF OF NEON AND THE SOLUTIONS PROVIDED BY PARTNERS SHALL NOT BE DEEMED TO BE PROVIDED BY NEON.

USER REGISTRATION

You may be required to register with the Site. You agree to keep your password confidential and will be responsible for all use of your account and password. If another person uses these methods to access your account, you will be responsible to pay for any Items they order, and we are not responsible for any other losses you suffer, unless the person using your password obtained it because we did not keep it secure. We shall not be liable for Orders that encounter delivery issues due to incomplete, incorrect or missing information provided by you. You are obliged to provide information that is complete, accurate and truthful for the proper processing of the Order, including your delivery address and contact information.

SERVIVE AVAILABILITY

Each Partner Restaurant might have a prescribed delivery area. This delivery area may change at any time due to factors such as weather, or demand on our service. This is to ensure that Items reach your door at their best. Our Partner Restaurants each decide their own operating hours. That means that the availability of our Service, and the range of Partner Restaurants from which you can order, depends on the Partner Restaurants in your area. If you try to order a delivery to a location outside the delivery area or operating hours of a Partner Restaurant, or the Application is otherwise unavailable for any reason, we will notify you that ordering will not be possible.

PARTNER LIABILITY

Partner Restaurants are responsible for the preparation, condition and quality of Goods. Partner Restaurants are responsible for delivery of the Goods and/or Orders. NEON shall not be liable for any loss or damage arising from your contractual relationship with the Partner Restaurants.

AGE RESTRICTED PRODUCTS

Age-restricted products (including alcohol) can only be sold and delivered to persons aged 18 or over. To purchase Alcohol, you must be of the statutory legal age. NEON, the Partner Restaurant, and their delivery riders reserve the right in their sole discretion to ask for a valid proof of age (e.g. ID card) to any persons before they deliver Alcohol. The Partner Restaurant and the delivery driver may refuse to deliver alcohol to any person who is or appears to be under the influence of alcohol. If delivery of any age-restricted product is refused, you will still be charged for the relevant Item and for delivery.

USER DATA PROTECTION

NEON care about data privacy and security. Please review our Privacy Policy. By using the Site, you agree to be bound by our Privacy Policy, which is incorporated into these Terms of Use.

THIRD-PARTY WEBSITE AND CONTENT

The Site may contain links to other website(“Third-Party Websites”) and by clicking on these links, you agree to do so at your own risk. NEON does not control or endorse these third party websites or links and shall not be responsible for the content of these linked pages. NEON accepts no liability or responsibility for any loss or damage which may be suffered by you in relation to your access and use of these third party links and websites.

INTELLECTIAL PROPERTY RIGHTS

All trademarks, logos, images, and service marks, including these Terms as displayed on the Platforms or in our marketing material, whether registered or unregistered, are the intellectual property of Nstory Pte. Ltd. (“NEON”) and/or third parties who have authorised us with the use (collectively the “Trademarks”). You may not use, copy, reproduce, republish, upload, post, transmit, distribute, or modify these Trademarks in any way without our prior express written consent. The use of Nstory Pte. Ltd. (“NEON”)'s trademarks on any other website not approved by us is strictly prohibited. Nstory Pte. Ltd. (“NEON”) will aggressively enforce its intellectual property rights to the fullest extent of the law, including criminal prosecution. Nstory Pte. Ltd. (“NEON”) neither warrants nor represents that your use of materials displayed on the Platforms will not infringe rights of third parties not owned by or affiliated with Nstory Pte. Ltd. (“NEON”). Use of any materials on the Platforms is at your own risk.

OUR LIABILITY

We have taken every care in the preparation of our Site and our Service. However, we will not be responsible for any errors or omissions in relation to such content or for any technical problems you may experience with our Site or our Service. If we are informed of any inaccuracies on our Site or in our Service, we will attempt to correct this as soon as we reasonably can. To the extent permitted by law, we exclude all liability (whether arising in contract, in negligence or otherwise) for loss or damage which you or any third party may incur in connection with our Site, our Service, and any website linked to our Site and any materials posted on it. This does not affect our liability for death or personal injury arising from our negligence, or our liability for fraudulent misrepresentation or misrepresentation as to a fundamental matter, or any other liability which cannot be excluded or limited under applicable law.

AMENDMENTS

NEON may amend these Terms at any time in its sole discretion. The amended Terms shall be effective immediately upon posting and you agree to the new Terms by continued use of the Platforms. It is your responsibility to check the Terms regularly. If you do not agree with the amended Terms, whether in whole or in part, you must stop using the Platforms immediately

JURIDICTION AND APPLICABLE LAW

The Singapore courts will have jurisdiction over any claim arising from, or related to, any use of our Services. These terms of use and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of Singapore.

PREVAILING LANGUAGE

In the event of a dispute as to the Terms, the English version shall prevail. The English language version of these Terms shall control in all respects and shall prevail in case of any inconsistencies with translated versions.
