Terms & Conditions

1. AGREEMENT TO TERMS

These Terms of Use ("Terms") govern your use of the websites, mobile applications, point-of-sale interfaces, queueing kiosks, ordering portals, loyalty services, and other digital services provided by Nstory Pte. Ltd. (referred to as "Nstory", "we", "our", or "us") (collectively, the "Platforms"). Please read these Terms carefully. By accessing or using the Platforms, you acknowledge that you have read, understood, and agreed to be bound by these Terms, our Privacy Policy, and any additional terms, conditions, and policies referenced herein. If you do not agree, you must immediately cease using the Platforms. By setting up your account or completing an order, you confirm that you accept these Terms. Supplemental terms posted on the Platforms from time to time are expressly incorporated by reference.

2. ABOUT US

The Platforms are operated by Nstory Pte. Ltd., a company incorporated and registered in Singapore. NEON is a service name of Nstory Pte. Ltd., not a separate legal entity. Nstory Pte. Ltd. is the contracting party and the organisation responsible for personal data as described in our Privacy Policy. Our registered office is at 60 Kaki Bukit Place, #03-13, Singapore 415979 (UEN 201220029K).

3. PURPOSE & NATURE OF THE SERVICE

Nstory operates a technology platform and online ordering, reservation, queueing, and loyalty system provider (the "Service") that connects users ("Users", "you") with restaurants and merchants that partner with us ("Partner Restaurants"). Through the Platforms, you may, depending on the Partner Restaurant, place orders for delivery, pickup, dine-in, or QR / table ordering; make table reservations and join queues; purchase, store, and redeem vouchers, coupons, and cashback (loyalty points); and complete surveys and provide feedback. Nstory's role is to link Users with Partner Restaurants. Nstory is not a party to any direct transaction or contractual relationship between you and a Partner Restaurant, and shall not be responsible for the preparation, quality, safety, availability, fulfilment, or delivery of any goods or services provided by Partner Restaurants. Partner Restaurants are not, and shall not hold themselves out to be, agents, employees, or staff of Nstory.

4. USER REGISTRATION & ACCOUNTS

You may be required to register with the Platforms to access certain features. You agree to provide accurate, complete, and truthful information (including delivery address and contact information), to keep that information up to date, and to keep your credentials confidential. You are responsible for all activity under your account and for any orders placed through it. We are not liable for orders that encounter issues due to incomplete, incorrect, or missing information provided by you. We may suspend or terminate any account where we reasonably believe these Terms have been breached, or where required by law or operational necessity.

5. ORDERS, RESERVATIONS, QUEUES & VOUCHERS

5.1 Submission and acceptance. Each Partner Restaurant determines its own operating hours, service availability, delivery areas, menu, and order acceptance criteria, which may change at any time due to factors such as weather, demand, or operational requirements. Submitting an order, reservation, or queue request is an offer subject to acceptance by the Partner Restaurant. If an order or reservation cannot be fulfilled (for example, outside operating hours or delivery area, or the Platform is otherwise unavailable), you will be notified.

5.2 Loyalty, cashback & vouchers. Cashback (loyalty points), vouchers, and coupons are subject to the conditions specified at the time of issuance, including expiry dates, redemption rules, and any Partner Restaurant-specific terms. We may require identity verification (such as phone-number lookup, OTP, or membership QR scan) before allowing redemption to prevent unauthorised use. Cashback and vouchers have no cash value, are non-transferable except as expressly permitted, and may be forfeited upon expiry, account closure, or breach of these Terms.

5.3 Refunds & disputes. Refund eligibility is governed by the relevant Partner Restaurant's policy. Disputes regarding goods and services should be raised through Nstory's official support channels, which will facilitate communication with the Partner Restaurant where appropriate.

6. PARTNER LIABILITY

Partner Restaurants are solely responsible for the preparation, condition, quality, safety, accuracy, and delivery of all goods and orders. Nstory shall not be liable for any loss, damage, injury, dispute, refund claim, or dissatisfaction arising from any goods, orders, delivery services, or interactions between Users and Partner Restaurants. You are responsible for ensuring that all orders, reservations, and queue requests submitted through the Platforms are accurate, genuine, lawful, and authorised. Nstory shall not be liable for losses arising from fraudulent, unauthorised, misleading, or malicious activity attributable to you.

7. FRAUD PREVENTION & USER RESPONSIBILITY

Users are strictly prohibited from:
  • submitting fraudulent, false, misleading, malicious, or unauthorised orders, reservations, or queue requests;
  • placing orders without a genuine intention to purchase the goods or services;
  • placing orders, reservations, or queue requests for tables, locations, or services they are not legitimately occupying or authorised to use;
  • repeated abusive no-show, last-minute cancellation, or harassment of Partner Restaurants;
  • misusing cashback, voucher, or loyalty mechanisms (including unauthorised account access or coordinated abuse);
  • circumventing security or rate-limiting controls (including the Open API);
  • engaging in any conduct intended to cause disruption, inconvenience, financial loss, or damage to Partner Restaurants, other Users, or the Platforms.

Nstory reserves the right, at its sole discretion, to investigate, reject, suspend, cancel, delay, or restrict any order, reservation, or queue request reasonably suspected to be fraudulent, abusive, unauthorised, or harmful; require mobile-phone verification, OTP, identity authentication, or other security procedures before accepting a transaction; suspend or terminate any account, device, IP address, or other access method associated with suspected fraudulent activity; and limit or block service to Users with excessive no-show or cancellation patterns. Users shall be liable to Nstory and the affected Partner Restaurants for any losses, damages, costs, expenses, or legal claims reasonably incurred as a result of fraudulent, unauthorised, unlawful, or malicious conduct. Partner Restaurants must address all fraud-related concerns through Nstory's official support channels and, where appropriate, through law-enforcement authorities; Partner Restaurants may not contact Users directly to investigate, confront, or resolve suspected fraud, nor request personal data from Nstory for self-help purposes.

8. AGE-RESTRICTED PRODUCTS

Age-restricted products (including alcoholic beverages) may only be purchased and delivered to individuals who have reached the statutory legal age in Singapore (18 for alcohol, or such other age as required by law). For age-restricted orders, Nstory, the Partner Restaurant, or the delivery person reserves the right to request valid government-issued identification before completing delivery or pickup. Delivery may be refused if sufficient proof of age is not provided, or if the recipient appears intoxicated or otherwise ineligible. Where delivery is refused for these reasons, charges for the relevant items and delivery fees may still apply.

9. USER DATA PROTECTION

Nstory is committed to protecting personal data and complying with the Singapore Personal Data Protection Act 2012 (PDPA). By using the Platforms, you acknowledge our Privacy Policy, which forms part of these Terms. Customer personal data shall not be disclosed to Partner Restaurants except where (i) reasonably necessary for order fulfilment, reservation, queueing, loyalty redemption, or related customer-service purposes; (ii) required by applicable law, court order, or lawful governmental request; or (iii) the customer has given separate, express consent. Partner Restaurants must use customer personal data solely for the purposes described above and in compliance with the PDPA. In the event of suspected fraud, abuse, or malicious activity, Partner Restaurants must escalate through Nstory's official support channels or to the appropriate law-enforcement authorities.

10. THIRD-PARTY WEBSITES & CONTENT

The Platforms may contain links to third-party websites, applications, or services ("Third-Party Websites"). You access them at your own risk. Nstory does not control, endorse, or assume responsibility for any Third-Party Websites or their content, and accepts no liability for any loss or damage arising from their use.

11. INTELLECTUAL PROPERTY

All trademarks, logos, service marks, illustrations, images, software, content, and other intellectual property displayed on the Platforms are the property of Nstory or its licensors and are protected by applicable copyright, trademark, and intellectual-property laws. You may not copy, reproduce, distribute, publish, transmit, modify, create derivative works from, reverse engineer, or otherwise exploit any content on the Platforms without Nstory's prior written consent. Use of any materials on the Platforms is at your own risk.

12. OPEN API & B2B PARTNERS

If you are a business partner accessing Nstory's Open API or B2B services, you must comply with the separate API Terms and Data Processing Agreement (DPA) entered into with Nstory. You may use personal data accessed through the Open API only for purposes expressly permitted under the DPA and the PDPA; must implement appropriate security and access controls; and may not engage in onward transfer or marketing use of personal data without separate authorisation by Nstory and the data subject's consent. Nstory may suspend or terminate Open API access at any time for breach, security risk, or operational necessity.

13. OUR LIABILITY

Nstory uses reasonable efforts to maintain the availability, security, and accuracy of the Platforms. However, Nstory does not warrant that the Platforms will always be uninterrupted, error-free, secure, or free from defects. To the maximum extent permitted by applicable law, Nstory excludes all liability — whether arising in contract, tort (including negligence), statutory duty, or otherwise — for any direct, indirect, incidental, consequential, special, exemplary, or punitive loss or damage arising from your use of the Platforms or the Service. Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence, or fraud or fraudulent misrepresentation.

14. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Nstory and its directors, officers, employees, agents, and Partner Restaurants from and against any claims, damages, losses, costs, and expenses (including reasonable legal fees) arising from: (a) your breach of these Terms; (b) your fraudulent, unauthorised, or unlawful use of the Platforms; (c) infringement of third-party rights; or (d) any content or data you submit to the Platforms.

15. SUSPENSION & TERMINATION

Nstory may suspend or terminate your access to the Platforms at any time, with or without notice, for breach of these Terms, suspected fraud or misuse, security risk, legal compliance, or operational necessity. Provisions which by their nature should survive termination (including Sections 6, 7, 9, 11, 13, 14, 17, and 18) shall survive.

16. AMENDMENTS

Nstory may revise these Terms at any time at its sole discretion. Material amendments will be notified through the Platforms or by email where appropriate. The amended Terms shall be effective immediately upon publication and your continued use of the Platforms constitutes acceptance. If you do not agree with the amended Terms, you must stop using the Platforms immediately.

17. FORCE MAJEURE

Nstory shall not be liable for any failure or delay in performance caused by events beyond its reasonable control, including acts of God, war, terrorism, civil unrest, pandemic, government action, labour disputes, network or power failures, or third-party-service outages.

18. JURISDICTION & APPLICABLE LAW

These Terms and any dispute, controversy, or claim arising out of or in connection with them (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of Singapore. The courts of Singapore shall have exclusive jurisdiction.

19. GENERAL

Severability: If any provision is held invalid or unenforceable, the remaining provisions shall continue in effect.
No waiver: Failure to enforce any right shall not constitute a waiver.
Assignment: You may not assign your rights without our prior written consent. Nstory may assign these Terms in connection with a corporate transaction.
Prevailing language: The English version of these Terms shall prevail in case of any inconsistency with translated versions.
Entire agreement: These Terms (with the Privacy Policy and any referenced documents) constitute the entire agreement between you and Nstory regarding the Platforms.
